Terms of Use
1. Acceptance of Terms
By downloading, installing, or using Sortsmith ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.
2. License
Subject to these Terms and the End User License Agreement (EULA), Ron Yahav ("Developer") grants you a personal, non-exclusive, non-transferable license to use Sortsmith on Mac computers that you own or control, for personal or professional use. The App is licensed, not sold.
3. Acceptable Use
You may use Sortsmith to organize files and folders on your Mac. You agree not to:
- Reverse-engineer, decompile, or disassemble the App except where permitted by law
- Modify, adapt, or create derivative works based on the App
- Remove or alter proprietary notices or branding
- Use the App in a way that violates applicable law or the rights of others
- Redistribute, sublicense, rent, lease, or sell the App except as expressly permitted by Apple or applicable law
4. Automated File Operations Warning
You are responsible for reviewing the rules you create, verifying destination folders, and maintaining current backups such as Time Machine or another backup system. To the maximum extent permitted by law, the Developer is not responsible for lost data, misplaced files, or unintended results caused by your configured rules, permissions, or local environment.
5. Your Responsibilities
You are responsible for:
- Granting and maintaining the correct folder permissions for the App
- Reviewing activity logs and rule order when troubleshooting behavior
- Keeping backups of important files before enabling automated rules
- Ensuring that your use of the App complies with all applicable laws and workplace policies
6. Intellectual Property
Sortsmith and all associated software, design, graphics, and documentation are the exclusive property of Ron Yahav and are protected by copyright and other intellectual property laws. The Sortsmith name and branding may not be used without prior written permission.
Apple and macOS are trademarks of Apple Inc., registered in the U.S. and other countries. Sortsmith is an independent product and is not affiliated with, endorsed by, or sponsored by Apple Inc.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR EVERY FILESYSTEM, WORKFLOW, OR CONFIGURATION.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow certain exclusions or limitations, portions of the above limitation may not apply to you.
9. Updates and Availability
The Developer may update, modify, suspend, or discontinue the App at any time. Updates distributed through the Mac App Store may change features or behavior. Continued use of the App after an update constitutes acceptance of the updated version and any revised terms.
10. Termination
Your rights under these Terms terminate automatically if you materially breach them. Upon termination, you must stop using the App and delete all copies in your possession or control.
11. Governing Law
These Terms are governed by and construed in accordance with the laws applicable in the Developer's jurisdiction of residence, without regard to conflict-of-law rules. Any dispute arising under these Terms shall be subject to the competent courts in that jurisdiction, except where applicable consumer law provides otherwise.
