Terms of Use
1. Acceptance of Terms
By downloading, installing, or using Custom Folder Design ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.
2. License
Subject to these Terms and the End User License Agreement (EULA), Ron Yahav ("Developer") grants you a personal, non-exclusive, non-transferable license to use Custom Folder Design on any Apple-branded Mac computers that you own or control, for personal or professional use. The App is licensed, not sold.
3. Acceptable Use
You may use Custom Folder Design to create custom folder icons and apply them to folders on your Mac. You agree not to:
- Reverse-engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Remove or alter any proprietary notices or labels
- Use the App in any way that violates applicable law
- Distribute, sublicense, or sell copies of the App
4. User-Generated Content
Any folder icons, designs, or exported images you create using the App are yours. The Developer makes no claim to ownership of content you create with the App.
5. Intellectual Property
Custom Folder Design and all associated software, design, graphics, and documentation are the exclusive property of Ron Yahav and are protected by copyright and other intellectual property laws. The "Custom Folder Design" name and associated branding may not be used without prior written permission.
Apple, macOS, and the Mac App Store are trademarks of Apple Inc., registered in the U.S. and other countries. Custom Folder Design is an independent product and is not affiliated with, endorsed by, or sponsored by Apple Inc.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PRODUCTIVITY, OR LOSS OF GOODWILL, ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
The Developer's total liability to you for any damages shall not exceed the amount you paid for the App.
8. Third-Party Services
The App does not integrate with any third-party services, accounts, or platforms.
9. Updates and Changes
The Developer reserves the right to update, modify, or discontinue the App at any time. Updates distributed through the Mac App Store may change features or behaviour. Continued use of the App after an update constitutes acceptance of any changes to these Terms if the Terms are revised with that update.
10. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you breach any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies in your possession.
11. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple Inc. is a third-party beneficiary of these Terms and will have the right to enforce these Terms against you as a third-party beneficiary thereof.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Developer resides, excluding its conflicts-of-law provisions.
